1. Introduction

Welcome to ZA Auto ("the Platform", "we", "us", "our"). ZA Auto is an online vehicle marketplace operated in the Republic of South Africa. By accessing or using our website, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the Platform.

2. Nature of the Platform

ZA Auto is a marketplace platform only. We connect buyers and sellers of vehicles. We are not a party to any transaction between users and dealers. We do not buy, sell, inspect, verify, or guarantee any vehicle listed on the Platform. All transactions are solely between the buyer and the seller.

3. Eligibility

You must be at least 18 years of age to use this Platform. By using ZA Auto, you confirm that you are 18 or older and have the legal capacity to enter into binding agreements.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and truthful information during registration.
  • We reserve the right to suspend or terminate any account at our sole discretion, without notice, for any reason including breach of these Terms.

5. Listings and Content

  • Dealers and users are solely responsible for the accuracy, legality, and completeness of their listings and any content they post.
  • ZA Auto does not guarantee the accuracy of any listing, description, price, image, or specification.
  • We reserve the right to remove any listing or content at any time without notice or liability.
  • Listings must not include stolen, unroadworthy, or fraudulently described vehicles.
  • You may not post misleading, defamatory, offensive, or illegal content on the Platform.

6. Prohibited Conduct

You agree not to:

  • Post false, misleading, or fraudulent listings.
  • Scrape, copy, or reproduce content from the Platform without written permission.
  • Use the Platform to harass, threaten, or defraud other users.
  • Attempt to gain unauthorised access to our systems.
  • Use bots, automated tools, or scripts to interact with the Platform.

7. Transactions Between Users and Dealers

ZA Auto is not involved in any transaction conducted between a buyer and a dealer. We do not:

  • Inspect or certify vehicles.
  • Guarantee the condition, roadworthiness, or legal status of any vehicle.
  • Handle payments between buyers and dealers.
  • Mediate or resolve disputes between buyers and dealers.

All buyers are strongly advised to conduct independent inspections and verify vehicle history before concluding any purchase.

8. Subscriptions and Payments

  • Dealer subscription fees are charged as described on the relevant pricing page.
  • Subscription fees are non-refundable unless otherwise stated in writing.
  • We reserve the right to change pricing with reasonable notice.
  • Payments are processed through third-party payment providers. ZA Auto does not store payment card information.
  • Failure to pay subscription fees may result in suspension of your dealer account and removal of listings.

9. Limitation of Liability

To the fullest extent permitted by applicable South African law:

  • ZA Auto shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Platform.
  • We are not liable for losses arising from transactions between users and dealers.
  • We are not liable for any inaccuracies in listings, fraudulent content posted by third parties, or vehicle defects.
  • Our total liability in any circumstance shall not exceed the subscription fees paid by you in the 3 months preceding the claim.

10. Intellectual Property

All content, branding, and technology on ZA Auto is the intellectual property of ZA Auto or its licensors. You may not reproduce, distribute, or create derivative works without our written consent.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Amendments

We reserve the right to amend these Terms at any time. Continued use of the Platform after changes are published constitutes your acceptance of the updated Terms. We will notify registered users of material changes where reasonably practicable.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
